New thematic report published - La discrimination dans le logement

A new publication has been released by the European Network of Legal Experts in the field of non-discrimination, entitled ‘La discrimination dans le logement’. The authors Julie Ringelheim and Nicolas Bernard address complex issues related to discrimination in the field of housing, aiming at providing a comprehensive analysis of the trends and patterns of discrimination occurring in this field, against the backdrop of relevant EU law as well as European and international human rights law. Thus, the report examines general situations of discrimination related to the offer, the attribution and occupation of different types of housing, as well as particularly complex issues such as housing for the Roma and Traveller communities and ensuring accessible housing for persons with disabilities. Thematic report on Discrimination against trans and intersex people on the grounds of sex, gender identity and gender expression published

A new publication has been released by the European Network of Legal Experts in the field of non-discrimination. The report ‘Discrimination against trans and intersex people on the grounds of sex, gender identity and gender expression’ authored by Silvan Agius and Christa Tobler addresses complex issues related to discrimination on the grounds of gender identity and gender expression, as well as discrimination on grounds of sex vis-à-vis intersex people. The report also clarifies the definitions used in the context of trans discrimination, and the terms used by the community to represent the diversity within it. This study highlights the obstacles and negative attitudes faced by this community and the difficulties with regard to legal recognition and rights. The report also extensively examines the influence of EU law, including case law, on trans discrimination and provides case studies of national legislation and case-law on gender identity and gender expression discrimination of some Member States where there are promising approaches which can and should serve as models for others to follow. The report is also available in German and French.

Thematic report - Evolution and Impact of the CJEU Case-Law

A new publication has been released by the European Network of Legal Experts in the field of non-discrimination. The report ‘The evolution and impact of the case-law of the Court of Justice of the European Union on Directives 2000/43/EC and 2000/78/EC authored by Colm O’Cinneide aims to provide a comprehensive overview of the evolution of the case-law of the Court of Justice of the European Union on the EU anti-discrimination directives (the Racial Equality Directive and the Employment Equality Directive). In particular, it will analyse how the Court has interpreted and applied the provisions of both directives and examine the impact of its jurisprudence. The study stresses in particular the reasoning that the Court has used to justify its decisions.

The sixth edition of the Comparative Analysis

The sixth edition of the Comparative Analysis – Developing anti-discrimination Law in the 27 EU Member States, Croatia, the Former Yugoslav Republic of Macedonia and Turkey is now available. The objective of the Comparative analysis, drafted by Isabelle Chopin and Thien Uyen Do (Migration Policy Group), is to compare and contrast the information set out in the 2010 country reports in a format mirroring that of the country reports annually prepared by the European Network of Legal Experts in the non-discrimination field. In addition, 10 years after the adoption of the Racial Equality Directive and the Employment Equality Directive, the Comparative Analysis reflects on the transposition of these landmark instruments and draws on some conclusions regarding the effective implementation of anti-discrimination law in Europe. Significant EU and national case-law and key issues are highlighted so to enrich the overview.

Anti-discrimination legislation in the US, Canada, South Africa and India: a comparative analysis

A new thematic report on anti-discrimination and equality laws in the US, Canada, South Africa and India has been published by the European Network of Legal Experts in the field of non-discrimination. This publication, authored by Sandra Fredman, compares and contrasts anti-discrimination and equality laws in those countries, giving some inspiration to future development of EU anti-discrimination laws.

Anti-discrimination Law Review issues

The European Anti-discrimination Law Review is a bi-annual publication produced by the European Network of Independent Legal Experts in the non-discrimination field, in order to provide an overview of the latest developments falling within the scope of the two EC anti-discrimination directives. Each issue contains two articles on recent legal trends. In addition, there are updates on legal policy developments at the European level and updates from the case law of the European court of Justice and the European Court of Human Rights. At the national level, the latest developments in non-discrimination law in the EU Member States, Croatia, FYR of Macedonia and Turkey are presented.
